Corporal punishment could go on trial in Bucks County Court. The case centers around 48-year-old Jay Colton of Newtown, who is charged with aggravated assault and other offenses for spanking his 14-year-old daughter with a Wiffle Ball bat in late January during a scuffle after she refused to get up for school.

At a recent preliminary hearing the girl said her father hit her on the arm, leg and buttocks with the plastic bat.  His lawyer said he was within his rights under state law, which permits corporal punishment unless the person administering it goes too far.  Prosecutors say he did go too far.  A Magisterial District Judge ruled that a jury should decide whether he went too far, and the case moves closer to trial in Bucks County Court.
