Pennsylvania State Police and the Montgomery County District Attorney’s office are investigating a Saturday night shooting incident that left one man dead and another wounded. It happened outside a home on Snyder Road in Upper Frederick Township, near the county’s Green Lane Park.  The dead man is 19-year-old Boyertown Area High School student Zachary Levin of Barto and the wounded man is 34-year-old Joshua Levin, also of Barto.

Investigators say a woman identified as Joshua Levin’s wife and Zachary’s mother had been living at the home with her boyfriend, and she called her husband to pick her up after an argument.  When they arrived, both Joshua and Zachary Levin got out of their car with baseball bats.  They pursued the man, bats in hands, and threatened to kill him.  When the man retreated to the rear of his property, he took a Ruger .40 caliber semiautomatic handgun from under the front seat of his truck.

After Zachary Levin struck the man with a baseball bat he fired a shot, and he fired one more as Joshua Levin came toward him with a bat poised to strike.  The coroner’s office ruled the death a homicide, and the DA’s office will determine whether it was justified under the new “Castle Doctrine” law, which lets people stand their ground if they believe they are in danger of death or serious injury.
